At 3 am Thursday morning I set off for Alamogordo, New Mexico. Yesterday I arrived back in Missouri after 9 pm, but didn't reach my destination until after 1.30 am Saturday morning ~ to say that I am "fit to be tied" is a slight understatement.
The case, D-1226-CR-200800062, "was on the docket as a financial reconstruction of the restitution payment and the court order read: "Court directs that Denise be given notice of proposed changes and opportunity to object."
In order to comply with that court order the District Attorney's office gave me flight tickets ($1,420) a shuttle service and hotel room. THAT was tax payers money.
A week prior to the hearing I had asked if the District Attorney's office knew of any homeless activists in the Alamogordo region because it takes someone skilled in homelessness to explain the physical, emotional and financial damages of having ones home stolen ~ especially in the prevailing recession/depression.
Not being able to find one through the DA's office I started contacting homeless shelters and groups, and when that failed I posted an announcement on twitter seeking one through a shelter or Occupy homes.
I entered the courtroom before criminal defense attorney Todd Holmes entered the courtroom, and he entered with the most obnoxious show of dramatics I have ever witnessed in a courtroom. "Where are these homeless advocates? Where is Occupy? Deliberately and maliciously making fun of my request for support from a knowledgeable source.
But after the judge entered Todd Holmes decided that he DIDN'T want to restructure the restitution payments.
So why on God's green earth did we spend so much tax payers money and why had I traveled across four states for this hearing if this wasn't about my money?
JUST to allow a criminal defense attorney to mock my request for a homeless advocate?
No, he wanted Robert Huckins to be allowed to return to working on homes as long as the jobs didn't require a building license. Handyman type jobs. I have lived in Lincoln County for a lot of years and hell will freeze over if any builder can earn a substantial amount working on projects that don't need a license or permits, handyman type jobs, UNLESS THEY ARE STEALING.
Judge Ritter asked if the Assistant DA objected, and when she said "No" I almost leaped out of my seat. I had traveled across four states for this hearing and I now started asking to be allowed to speak because THAT is why I had been transported so far. I was simply furious.
The ONLY protection anyone had from becoming a victim of Robert Huckins was that probation order restricting him from all area's of the building/housing/renovation trade. Had he done so and stolen more money his probation would be revoked and action would have .... in normal judicial systems.. been swift. It was the one document that gave law enforcers some leverage if they came across a new victim.
But on the 16th of August it was taken away and the 12th District Attorneys office gave their approval for Robert Huckins to take a second shot at the honest citizens who may hire him to do ANYTHING.
The Assistant District Attorney justified this move on the grounds that "we can't stop him anyway." We can't stop him? I must be losing my ever loving mind. We can't stop people from murdering others but we can't give our permission for attempted murders. I have never heard anything so ludicrous in my life. "We can't stop him."
After Judge Ritter departed a conversation started between the Assistant DA and the criminal defense attorney that was the straw that broke the camels back as far as I am concerned. Both agreed that the case of Robert Huckins was not criminal but civil, and as their conversations went on my blood started to rise. NOT CRIMINAL?
That was it. I walked out of that court room screaming angry. A shouting match started between the Assistant DA and I that alerted security. Dozens upon dozens of victims have been irreparably damaged by Robert Huckins. One victim ( Dorothy McKeever) died trying to get the money for her home back and I have been left homeless and this wasn't a criminal case?
The Assistant DA, after I refused to be silenced and continued to scream about her allowing Huckins to go down the road and victimize more people, told me that if I had been left homeless she would take me to a shelter. When I said my HOME she responded, "Oh now you are being picky."
According to the Assistant DA I am being "picky" for wanting a home or wanting Huckins IN JAIL?
WHAT DOES SHE LIVE IN??
Let us give a run down on the situation in a few cases only. Remembering that MY case is one of dozens involving Robert Huckins.
Action: Robert Huckins embezzled all of our building fund. He them mocked the state police white crime investigators in a manner no-one should be allowed to taunt and mock.
Consequence: Probation and a measly $114 pr week payment for a period of 4 years after which he has to give me a "promissory note" for an amount that will exceed $82,000. A promissory note not worth the paper it is written on.
Action: Robert Huckins walked into a local real estate company and said that he had the power of attorney from an out of state client who had asked him to sell her land with or without a custom home on it. The real estate agent, because his daughter was a friend of the family through Dr. Kenneth Ogilvie, accepted Robert Huckins word and never asked to actually SEE the power of attorney. I was the so called "out of State" owner Huckins was referring to, even though I was less than 7 miles away totally oblivious to what was happening. ( Officer John Barnes gave testimony to these facts in a 2008 court trial.)
Consequences: None
Action: Bounced/hot checks given to employee's, businesses, sub-contractors and contractors. All of the active hot checks were handed in to the District Attorney's office.
Consequences: None
Action: Several clients who have had their funds stolen file in civil cases, and win the judgment cannot actually get their funds returned. After years of pressing the CIVIL courts for restitution Robert Huckins filed bankruptcy and wipes those victims off the map.
Consequences: None
Action: The tax and revenue issue a restraining order forbidding Robert Huckins from conducting his contracting and building business. He totally ignores them and continues on for a period of up to another ten years.
Consequences: None
And THESE actions are NOT CRIMINAL because the criminal courts (according to the Assistant DA and criminal defense attorney) cannot deal with such cases, and they should have been heard in a civil court!
How many levels of despair can a convicted felon be allowed to take a person to, and why does the New Mexico judicial service allow this continued abuse to be inflicted upon the innocent, at the tax payers expense?
Dr. Ogilvie, what part of these words did you REALLY mean, because it seems that leaving women homeless does not fit into your compassion towards the very women you claim to help. Warm and tender spirit is the LAST thing we have experienced. We have had nothing but unbelievably cruel abuse and horrendous mistreatment.

The Huckins family clan have won. They are far too powerful to bring to justice in this wild west court and I throw down the gauntlet and give them to God. THEY need Him!
At this hearing I learned that Wayne Jordon had passed away shortly after he was involved in my case. On Thursday I missed him greatly - and needed him desperately. THAT was an assistant DA who knew a criminal when he saw one. My condolences to his family.
There has to be someone related to Robert & Sylve Huckins must have some means to reach them, if it be Michael Huckins, Dr.Kenneth Ogilvie ( Diana Huckins? Dominic Huckins? Malcolm Huckins? ) or Patricia Ogilvie-Huckins and get them to return ALL of the money they stole from us so that I can buy a home and get our lives back. I am begging anyone in this family for help.
I don't believe I have EVER witnessed any none violent crime that can be as devastating as stealing someone's home. I am walking in Dorothy McKeevers footsteps, day by day, month by month, year by year.
Liam Griffin, I sat in your law office with two witnesses as you gave me your promise, your guarantee, that our money would be returned before harm came to us.
Patricia Ogilvie-Huckins you were present the day I signed contract with your son. You walked out of the kitchen with Sylve Huckins and your son introduced me to you. He told you that I was the British horse trainer he had told you about, the one he was going to build the home and barn for. Why didn't you say something? There may be a rational and reasonable explanation but I have spent over 3 years, homeless, not understanding it. I understand it even less knowing that though I was a total stranger, both Dorothy McKeever and Sally Canning you KNEW, and you knew what your son had done to them and others.
Dr. Kenneth Ogilvie, I contacted you and simply asked for a reference, not knowing that Robert Huckins was your cousin. Robert Huckins had just stolen over $30,000 from the domestic violence shelter, HEAL, yet everyone was trying to hide it. There was a history of stealing large amounts of money. $65,000 PLUS from Nancy Canning. $89,000 PLUS from Dorothy McKeever, $45,000 from Francis McKinney. The list just goes on and on and on.
Because of Robert Huckins I ended up paying $140,000 to be homeless.. sat in the cold, emotionally, physically and financially broke. In the middle of a recession, with no way to recover the stolen funds.Today Robert Huckins has his own home...
He also has OUR home.....
He also has a lot of people's money...
And his freedom.
Women are not banks or loan institutions. Women should not be the source of a retirement fund for people who don't want to do an honest day's work for an honest day's pay. Holding women hostage while playing with the judicial system, a horrendous game of cat and mouse extending YEARS, with the victims whose very homes, families and stability are in jeopardy is cruelty, as cruel as a physical beating. It is financial and emotional RAPE. Homelessness is not justice. It is a slow, painful death.
Please, I beg with everything I have within me, please convince Robert Huckins to stop this torture and return the building fund he stole from us so we too, can have a home.
